NON-RESIDENT STUDENTS

Administrative Procedure

  1. Definitions

    1. Nonresident Student-- any student whose parent(s) do(es) not reside in Garrett County.

    2. Legal Guardian--guardianship based on a court order from the Circuit Court of Garrett County naming a resident of Garrett County as the guardian.

  2. In order for any nonresident student to be enrolled in Garrett County Schools

    *a legal document must be presented by the guardian (for Section IV. A. below)

    *a written statement explaining why the student is living with someone other than the parent must be presented by the parent (for Section IV. B., C., or D., below)

  3. The above information is forwarded to the Director of Pupil Services. The situation is evaluated by the Director of Pupil Services or his designee and a decision to waiver or require payment of tuition is made.

  4. Waiver of tuition may be granted in cases that fit the following general classification:

    1. Any student living with a non-parent who has legal guardianship (see section V, 5 for exception).

    2. Students of families that plan to establish a residence in the county during the first nine weeks of the school year.

    3. Students of families moving out of the county will be allowed to complete the grading term during which the family moved.

    4. Students who have completed the 11th grade in Garrett County and whose family has moved to another area after the student's successful completion of the 11th grade.

  5. Payment of tuition will be assessed for cases that fit the following general classifications:

    1. Students of families that plan to establish a residence in the county in a time frame other than IV.B., above.

    2. Students of families moving out of the county wishing to remain longer than the grading term in which their family moved.

    3. Students placed here from another state or county, who are placed in a group or foster home through a-recognized community agency.

  1. Situations not covered under IV and V of this administrative procedure will be reviewed by the Director of Pupil Services and a decision to waiver or require payment of tuition will be made.

  2. Students for whom tuition will be charged will be admitted/permitted to remain with the payment of tuition based on the per capita cost less state aid for the current school year for Maryland residents and a full per capita cost for students whose families live in other states.

  3. Students residing in neighboring political subdivisions and whose tuition is paid by that district need not follow the above outlined procedure.

  4. Students living near boundary lines as described under Maryland Article 77,Section 52 (Public School Law 4-120) need not follow the above procedure.

  5. Bonafide exchange students are exempt from the conditions of this administrative procedure.

  6. All nonresident applications will be reviewed on a regular basis with situations being modified as required.
